1. GENERAL CONDITIONS

1.1 These terms of use apply to the rights and obligations arising from the purchase of goods or services by www.flameguard.ee Online Store customers (hereinafter the Customer) and Flameguard systems OÜ (hereinafter the flameguard.ee).

1.2 When registering as a flameguard.ee user and purchasing products, the terms and conditions of this Agreement and the rights and obligations arising from the legislation of the Republic of Estonia apply. In addition to these general sales conditions, the relationship between the Customer and the flameguard.ee is governed by www.flameguard.ee product information, price list and purchase information.

1.3 the flameguard.ee reserves the right to make unilateral changes in terms of use and sales prices. These changes will be reflected on the www.flameguard.ee website.

1.4 If the Customer forwarded his or her order before the amendments to the terms and conditions entered into force, the Customer shall be subject to the terms and conditions in force at the time of the forwarding of the order, unless otherwise provided by law or these terms and conditions.

2. PRICE LIST

2.1 All www.flameguard.ee online prices are generally expressed in euros (€) and include VAT, but may also be in a different currency depending on the language of the country of destination chosen.

2.2 The prices of goods or services or services do not include the cost of delivering the goods, are calculated when the order is made and are added to the final price of the order. 3. CONCLUSION OF SALES CONTRACT

3.2 Once the customer has confirmed the order, an advance invoice is sent immediately to the e-mail address entered by the customer, which is the basis for payment for the goods. If the customer's e-mail address has not received confirmation of the order since the order was formalised, please contact the shop@flameguard.ee.

3.3 The advance invoice shows the products ordered by the Customer and the contact details to which the order is sent. The prepayment invoice also contains the flameguard.ee information and the bank account to which the payment can be made.

3.4 When making an order, the Customer chooses the method of delivery and method of payment (bank, cash or credit card) and checks, verifies the correctness of the data of the recipient and the payer.

3.5 A sales contract is deemed to have been concluded if the order has been approved and the Customer has paid 100% of the amounts due. All contracts entered into shall be kept in a flameguard.ee online shop.

3.6 Execution of the order starts immediately after the amount due has been received in the flameguard.ee current account.

3.7 If the Customer has not paid the prepayment invoice within 2 working days from the issue of the prepayment invoice, the flameguard.ee considers it Customer's wish to cancel the purchase and cancel the order.

3.8 flameguard.ee by making an order in an online shop and making an advance payment, the Customer confirms that he or she has read and agrees to the terms of use, they are clear, understandable to him or her, and he or she undertakes to follow them.

3.9 Payment methods:

3.10 Flameguard systems OÜ is the controller of personal data and transfers the personal data necessary for making payments to the processor payment Maksekeskus AS.

4. DELIVERY AND DELIVERY OF GOODS

4.1 After the contract of sale enters into force (payment of the advance invoice), the products are delivered to the address provided by the Customer in the order.

4.6 Shipments damaged during transport, where products, but not packaging, have been damaged, have been replaced by customers. If substitution is impossible, we offer compensation for the cost of damaged goods.

5. WARRANTY AND RETURN OF PRODUCT

5.1 All products sold in the www.flameguard.ee Online Store are 100% originals. The images attached to the products have an illustrative meaning. The return application must contain the reason for the return, the name of the customer, the name of the product and the invoice or order number.

5.4 In the event of a defect in the product, the Customer undertakes to inform the shop@flameguard.ee by e-mail with the following information: The name and contact details of the client; the date on which the complaint was lodged; defect in product, please include photos. the requirement for the flameguard.ee; invoice number, if possible, add a copy of the invoice. The corresponding application must have been sent no later than 14 days after the defect was detected.

5.5 the flameguard.ee is not responsible for: Damage to the product caused by the fault or negligence of the client; defects resulting from the unintended use of the product; natural physical wear of the product in normal use.

5.6 The costs of return of the goods shall be borne by the Customer. the flameguard.ee shall bear the costs of return if the goods are damaged which could not be detected by external inspection and which have not occurred when the packaging was opened or if the goods are not those ordered.

5.7 Money for returned goods shall be reimbursed to the customer's current account within 30 days of receipt of the application for withdrawal. In addition to the cost of the returned item, the delivery costs of the item are also returned.

5.8 If the Customer wishes to exchange the returned product for another product or another size of the same product, the Customer shall pay the postal cost for the returned product unless the return is due to non-conformity with the order or current goods.

5.9 If the returned product has deteriorated and the deterioration is caused by circumstances not caused by the flameguard.ee and as a result of the unintended use of the product, the flameguard.ee has the right to set off the decrease in the value of the product against the amount paid by the Customer for the product and to be returned to the Customer.

6. LIABILITY AND FORCE MAJEURE

6.1 the flameguard.ee is liable to the Customer for damage caused by the flameguard.ee in violation of these conditions in the cases and to the extent provided for in the legislation in force in the Republic of Estonia.

6.3 Neither party is liable to the other party and its conduct is not considered to be in breach of these conditions due to the delay or failure to perform any of its obligations if the reason for such delay or failure was not controlled by that party (force majeure).

6.4 the flameguard.ee does not compensate for the moral prejudice that a change in delivery times, prices and other terms and conditions may cause to the customer under these terms and conditions.

6.5 the flameguard.ee does not compensate for the Customer's expenses arising from the fact that the Customer assumed obligations towards third parties (non-flameguard.ee dependent) under conditions contrary to these terms and conditions.

6.6 the flameguard.ee does not compensate the customer for missed opportunities as a result of changes in delivery times, prices and other conditions.

6.7 the flameguard.ee is not responsible for disruptions in the operation of the online shop due to malfunctions in systems, communication networks, stations belonging to third parties or interference with the provision of third party services used by the online shop.

6.8 The price of the goods (goods or services or services) ordered by the Customer limits the amount of damages that the flameguard.ee must make good.

7. PRIVACY

4. In matters not regulated by these conditions, the Customer and the www.flameguard.ee shall be guided by the legislation in force in the Republic of Estonia and other acts regulating relations between the Parties.

5. Differences of opinion and disputes arising from the fulfilment of these conditions shall be settled in particular by negotiation between the parties. If disputes arising from a contract cannot be resolved by negotiations between the parties, both the Customer and the www.flameguard.ee have the right to apply to the Consumer Protection Board or the Court of Justice for the protection of their rights.

8. FINAL PROVISIONS

8.1 The law of the Republic of Estonia applies to these order terms and flameguard.ee e-store purchase and sale contracts. If any of the provisions of the terms of the order are void, the validity of the terms of the order or the purchase and sale agreement will not be affected for the remainder. The void provision shall be replaced by the legal provision which is the closest legal and economic to the void provision.

8.2 Any issues not covered by these rules will be resolved in accordance with the laws of the Republic of Estonia.
